General Terms and Conditions of Velocity V1x Marketing – FZCO

Velocity V1x Marketing – FZCO (“the Company”) acts as an intermediary for automated trading systems developed by third-party providers. The Company does not provide any financial advice and does not render financial services within the meaning of the German Banking Act (KWG), the German Securities Institutions Act (WpIG) or the German Financial Investment Brokerage Ordinance (FinVermV). All information, materials and tools provided serve general information purposes only and do not constitute individual investment advice or a financial recommendation. They are a software solution.

1. No financial advice or financial services

The Company acts exclusively as an intermediary for automated trading systems and does not provide any financial advice within the meaning of the German Banking Act (KWG) or the German Securities Institutions Act (WpIG). Velocity V1x Marketing – FZCO does not act as a financial adviser, financial service provider or asset manager and accepts no responsibility for investment decisions or for the success of trading strategies pursued using the system provided.

The systems and tools we provide are not designed to take account of the individual needs or objectives of the user. All trading decisions and investments lie exclusively within the user's own responsibility.

2. The user's own responsibility

Use of the systems provided is entirely at the user's own responsibility. The user is aware that trading in financial instruments, in particular through the use of automated trading systems, involves substantial risks, including the possible total loss of the capital invested. The user bears sole responsibility for their trading decisions and the risks associated with them.

The user is advised that no guarantee is given as to the success of the trading systems. Past performance of the systems or simulated results offer no assurance whatsoever of future results. The user trades at their own risk, and the Company accepts no liability for losses or damages arising from the use of the systems.

3. No management of capital by Velocity V1x Marketing – FZCO

The Company does not at any time manage or control the user's capital. All payments, investments and transactions are settled directly between the user and the provider of the trading system or the trading platform. Velocity V1x Marketing – FZCO has no access whatsoever to the user's funds and bears no responsibility for their management or use.

The Company is responsible neither for the selection of the trading systems nor for the outcome of the trading decisions made by the user using the systems provided.

4. Independent advice and risk management

It is strongly recommended that, before using the systems provided, the user obtains independent advice from a licensed financial adviser or tax adviser in order to assess whether the systems are suitable for their individual financial objectives, risk appetite and investment strategies. The user should inform themselves comprehensively about the potential risks and the way the automated trading systems work before making any investment.

The user is aware that they bear full responsibility for their own financial decisions and that the Company has no influence whatsoever on those decisions.

5. Limitation of liability and exclusion of legal claims

Velocity V1x Marketing – FZCO accepts no liability for losses, damages or any adverse effects incurred by the user through the use of the systems provided. This includes direct or indirect losses, commercial damages, losses due to system errors, market fluctuations or poor decisions by the user.

Any claims for damages or legal claims against the Company arising from losses incurred through the use of the systems are expressly excluded.

The user agrees that no claims may be asserted against Velocity V1x Marketing – FZCO, as the Company has no control over trading results or market movements and acts solely as an intermediary.

6. Confirmation of the risk warning and of personal responsibility

By using the services of Velocity V1x Marketing – FZCO, the user confirms that this disclaimer and all risks associated with the use of the systems have been explained to them in detail and in full. The user declares that they assume full personal responsibility for their investments and that they have understood the risks associated with the use of the system.

This confirmation is given without signature and is binding. The user expressly declares that they have understood the information provided and that they act at their own responsibility. Should no document have been handed over, this document on the website shall be deemed binding and valid without signature.

By using our services you confirm that you have taken note of this disclaimer, that you understand it and that you expressly act at your own responsibility. You declare that you assume the full risk for any and all losses and that actions or liability claims against Velocity V1x Marketing – FZCO arising from losses or trading decisions are excluded.
